1. Acceptance of These Terms

These Terms & Conditions ("Terms") govern your access to and use of theaudiosouq.com and our official WhatsApp ordering channel (together, the "Platform") and any purchases you make through them. By browsing the Platform, registering an account, or submitting an order request, you agree to be bound by these Terms and by our Privacy Policy, Shipping Policy, and Refund & Warranty Policy, which are incorporated herein by reference.

If you do not agree to these Terms, please do not use the Platform.

The Audio Souq is the commercial trading name of Prosound Electronics FZE LLC, a limited liability enterprise licensed under the Sharjah Publishing City Free Zone (SPC Free Zone), Sharjah, United Arab Emirates.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract under UAE law to place an order on the Platform. If you are registering an account or purchasing on behalf of a studio, production house, or corporate entity, you confirm that you are authorized to bind that entity to these Terms.

4. Products, Sourced-on-Order Items & VAT Pricing

• 100% Genuine Pro Audio Guarantee: All professional audio equipment sold on the Platform (including microphones, audio interfaces, studio monitors, mixers, and acoustic hardware) is 100% genuine, brand-new inventory sourced directly from authorized regional distributors or manufacturers with full warranty support.
• VAT-Inclusive Pricing: In compliance with UAE Federal Decree-Law No. 8 of 2017 on Value Added Tax, all prices on the Platform are listed in United Arab Emirates Dirhams (AED) and are inclusive of the statutory 5% UAE VAT.
• Sourced on Order Workflow: To supply the newest production batches, items marked "Sourced on order" are procured from our distributor network following your order request. Order sourcing is conducted until our daily cutoff of 5:00 PM GST (with a 24-48 hour confirmation SLA). Orders placed over the weekend are sourced and confirmed by 5:00 PM on Monday.
• Pricing Corrections: If an item is incorrectly priced due to a typographical or supplier error, we reserve the right to cancel the request, notify you immediately, and refund any collected funds in full.

5. Order Submission & Contract Formation

Submitting an order online or via WhatsApp generates a preliminary order request. Because inventory is verified in real-time with authorized distributors, your initial confirmation represents an order receipt, not final contractual acceptance. The binding contract between you and Prosound Electronics FZE LLC is formed when we verify distributor stock, approve your Pro-Forma Quotation, receive payment, and dispatch your equipment.

6. Payment Gateways & Invoicing

We accept major credit/debit cards (processed via secure, PCI-DSS compliant gateways like Stripe) and approved installment methods (such as Tabby). Card details are never stored on our servers. An official UAE VAT-compliant Tax Invoice containing our TRN (104860760800003) is generated for every settled order and made available for instant download in your profile.

7. Delivery & Shipping

Delivery across the UAE is free for orders of AED 500 or more, with a flat delivery fee of AED 25 for orders below AED 500. Delivery timelines and driver WhatsApp coordination rules are detailed in our Shipping Policy.

8. Cancellations, Returns & Manufacturer Warranty

Orders can be cancelled free of charge at any time prior to courier dispatch. Because pro audio equipment is sourced specifically to order from authorized brand distributors, we do not accept change-of-mind returns on delivered items. All equipment is protected by official 1 to 3 year manufacturer warranties and statutory defect protections under UAE Federal Law No. 15 of 2020. See our Refund & Warranty Policy for full details.

9. Promotional Codes & Coupons

Promotional codes (such as VIP rewards or welcome vouchers) are valid strictly for specified eligible categories, are limited to one use per order, cannot be combined with other promotional discounts unless explicitly authorized, and hold no cash redemption value.

10. User Accounts & Security

You are responsible for maintaining the confidentiality of your account password and for all activity under your profile. If you suspect unauthorized access, contact us immediately at support@theaudiosouq.com.

11. Intellectual Property

All content on the Platform (including The Audio Souq brand, logo, graphic interfaces, website design, and editorial articles) is owned by Prosound Electronics FZE LLC. Third-party brand names and trademarks (including Austrian Audio, Beyerdynamic, Dynacord, Electro-Voice, RME, and Zoom) remain the intellectual property of their respective manufacturer owners and are referenced solely to describe genuine pro audio equipment sold as an authorized reseller.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the federal laws of the United Arab Emirates and the regulations of the Sharjah Publishing City Free Zone. Any unresolved dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Sharjah, UAE, without prejudice to your statutory right as a consumer to submit a complaint to the UAE Ministry of Economy (consumerrights.ae) or the Sharjah Department of Economic Development (SEDD).
